Samantha Eisen

Principal and Founder

Samantha is an effective advocate for her clients, using her background in psychology and experience as both a family lawyer and civil litigator to help clients navigate difficult legal processes with a focused, balanced, and trauma-informed approach. She aims to empower clients by providing options, guidance, and advice in an empathetic and supportive manner, while encouraging them to make choices that best serve their needs and interests. Clients appreciate Samantha’s ability to help them understand what is happening and what to expect along the way.

Samantha practices in all areas of family law, with a particular focus on complex income and property issues, child and spousal support, parenting and decision-making, and matters involving intimate partner violence, gender-based violence, and spousal assault and abuse.

A trained collaborative lawyer with a Master of Laws in Dispute Resolution, Samantha draws on her settlement training and experience to help clients reach their goals through fair, practical, and sustainable solutions. She works closely with clients to identify what matters most to them and guides them toward resolution through negotiation and settlement wherever appropriate. Samantha has extensive experience drafting complex and creative separation agreements, marriage contracts, and cohabitation agreements, and regularly assists clients through negotiation between counsel, the collaborative process, and mediation.

When settlement is not possible, Samantha is a strong and dynamic litigator. She has successfully represented clients at all levels of court, including the Ontario Court of Justice, the Ontario Superior Court of Justice, the Ontario Court of Appeal, and the Supreme Court of Canada.

Prior to establishing Samantha Eisen & Company, Samantha practiced family law at two highly respected boutique law firms in Toronto — the first exclusively in family law, and the second in both family and civil litigation with a focus on cases involving gender-based violence, assault, and abuse.

Samantha is active in both the legal profession and the community. She volunteers for the Luke’s Place Virtual Legal Clinic, providing summary legal advice to survivors of domestic violence, and for the Pro Bono Students Canada Family Justice Centre, where she supervises law students and provides free legal services to those in need. Samantha also provides summary legal advice through the Independent Legal Advice for Survivors of Sexual Assault Program with the Barbra Schlifer Commemorative Clinic. Since 2018, she has served as an adjunct mooting advisor for the Walsh Family Law Negotiation Competition at the University of Toronto.

Samantha is a member of the Ontario Bar Association, the Canadian Bar Association, the Women’s Law Association of Ontario, the Ontario Trial Lawyers Association, the Toronto Lawyers Association, The Advocates’ Society, the Ontario Association of Collaborative Professionals, and the Law Society of Ontario.
